Terms of service

Overview

These Terms of Service govern access to and use of casalx.shop and purchases made through our online store.

Throughout these Terms, references to "we", "us" and "our" refer to the operator of casalx.shop.

References to "you" and "your" refer to visitors, customers and users of the website.

By accessing our website or submitting an order, you agree to these Terms to the extent that they lawfully apply.

Nothing in these Terms excludes or limits mandatory consumer rights.

Eligibility

You may use casalx.shop only for lawful purposes.

By placing an order, you confirm that you have legal capacity to enter into the relevant purchase contract or have appropriate authority to do so.

You must provide accurate information during checkout.

Website Availability

We aim to keep casalx.shop reasonably available, but we do not guarantee uninterrupted or error-free access.

The website may occasionally be unavailable because of maintenance, technical problems, security requirements, third-party service interruptions or circumstances outside our reasonable control.

Product Information

We make reasonable efforts to display product descriptions, photographs, specifications and pricing accurately.

Minor differences may occur because of screen settings, photography, production batches, manufacturing tolerances or natural characteristics of materials.

These provisions do not limit statutory rights where a product is materially misdescribed or otherwise non-conforming.

Product Availability

All products are subject to availability.

Adding a product to a shopping basket does not reserve inventory.

If a product becomes unavailable after an order is submitted, we may cancel the affected part of the order and refund any amount properly paid for that product.

Prices

Prices displayed on casalx.shop may change from time to time.

The price applicable to an accepted order will normally be the price shown during checkout.

We reserve the right to correct obvious or material pricing errors.

Where a pricing error is identified before an order is accepted, we may contact the customer to offer the opportunity to proceed at the correct price or cancel the affected order.

Payments

Customers must use a payment method available through checkout and must be authorised to use that payment method.

Payment may be subject to authorisation and anti-fraud checks by payment providers.

We may decline an order where payment cannot be authorised.

Order Process

Customers should review their basket, delivery details and payment information before submitting an order.

After an order is submitted, we may send an electronic acknowledgement.

The contract between us and the customer will be formed when the order is accepted in accordance with our checkout and order-confirmation process.

We reserve the right to refuse an order for legitimate reasons, including suspected fraud, payment failure, unlawful activity, unavailable inventory or material pricing errors.

Shipping

Standard shipping is free on all orders.

Our normal estimated delivery timeframe is 15–20 calendar days.

Delivery times are estimates unless expressly agreed as guaranteed.

Customers are responsible for supplying an accurate and complete delivery address.

Further information is contained in our Shipping Policy.

Delivery Risk

Where goods are delivered using a carrier selected or arranged through us, responsibility for accidental loss or damage generally remains with the seller until the customer, or a person nominated by the customer, takes physical possession of the goods, subject to applicable law.

Cancellation, Returns and Refunds

Eligible UK consumers may have a statutory right to cancel distance purchases.

Separate statutory remedies apply to faulty and non-conforming goods.

Our Return and Refund Policy forms part of these Terms and explains applicable procedures.

Promotions

Discount codes and promotions may be subject to additional conditions.

Unless otherwise stated, promotional codes cannot be exchanged for cash.

We may withdraw a promotion prospectively or refuse fraudulent or abusive use of a promotion.

Withdrawal of a promotion will not improperly affect an order already accepted under applicable terms.

Accounts

Where customer accounts are available, customers are responsible for maintaining the confidentiality of account credentials.

Customers should notify us if they reasonably believe their account has been accessed without authorisation.

We may restrict or suspend an account where necessary to protect security or prevent fraud.

Prohibited Uses

You must not use casalx.shop:

  • For an unlawful purpose;
  • To solicit unlawful acts;
  • To infringe intellectual-property rights;
  • To transmit malicious code;
  • To attempt unauthorised access to systems;
  • To interfere with website security;
  • To submit fraudulent orders;
  • To impersonate another person;
  • To collect information unlawfully; or
  • To otherwise misuse the website.

We may restrict access where reasonably necessary in response to misuse.

Intellectual Property

Website content, including text, graphics, logos, design elements, photographs, product presentation and software, may be protected by copyright, trademark and other intellectual-property rights.

Except as permitted by law, users may not reproduce, distribute, sell, publish, commercially exploit or create derivative works from protected website content without appropriate authorisation.

Reviews and User Content

Where customers are permitted to submit reviews or other content, they must ensure that the content is lawful and does not infringe the rights of another person.

We may moderate or remove content where reasonably necessary because it is unlawful, defamatory, threatening, fraudulent, misleading, infringing, obscene, abusive or otherwise inconsistent with legitimate operation of our website.

Third-Party Services

Our website may integrate third-party services such as payment processors, delivery providers, analytics providers or social platforms.

Third-party services may be subject to separate terms and privacy policies.

We are not responsible for the independent conduct of third parties except to the extent that applicable law makes us responsible.

Third-Party Links

casalx.shop may occasionally contain links to external websites.

Links are provided for convenience and do not necessarily mean that we endorse the external website or its content.

Customers should review the terms and privacy practices of third-party websites separately.

Accuracy of Website Information

We aim to maintain accurate information but may correct typographical errors, technical errors, inaccuracies or omissions.

Changes that materially affect an already concluded consumer contract will be handled according to applicable law.

Security

Users must not attempt to compromise the security, availability or integrity of casalx.shop.

We may use reasonable technical and organisational measures to detect and prevent fraud, abuse and cyber-security threats.

Disclaimer

Nothing in these Terms guarantees that the website will always be completely free from technical errors.

However, nothing in these Terms excludes any obligation that cannot legally be excluded, including statutory obligations relating to goods sold to consumers.

Limitation of Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

In particular, nothing is intended to exclude or limit liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability that cannot lawfully be excluded.

For consumers, we remain responsible for foreseeable loss and damage caused by our breach of contract or failure to use reasonable care and skill where the law requires us to be responsible.

We are not responsible for losses that were not reasonably foreseeable when the contract was entered into, except where applicable law provides otherwise.

Nothing in this section affects statutory consumer remedies.

Force Majeure and Events Outside Our Control

We will not be responsible for delay or failure caused by circumstances outside our reasonable control to the extent permitted by law.

Such circumstances may include natural disasters, severe weather, transport disruption, industrial action, war, civil disturbance, government action, telecommunications failures or major carrier disruption.

If such an event materially affects an order, we will take reasonable steps to communicate with the customer and perform our obligations when reasonably possible.

Statutory cancellation or refund rights remain unaffected.

Indemnity

Any indemnity or similar obligation in these Terms applies only to the extent lawful and will not operate to remove rights provided to consumers by mandatory law.

Privacy

Use of personal information is governed by our Privacy Policy.

By using our website, users acknowledge that personal information may be processed as described in that policy and in accordance with applicable law.

Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.

No Waiver

A failure to enforce a right immediately does not necessarily mean that the right has been waived.

Entire Agreement

These Terms, together with policies expressly incorporated into them, describe the principal terms governing use of casalx.shop and purchases from our online store.

Nothing in this clause excludes representations or rights that cannot legally be excluded.

Changes to These Terms

We may update these Terms from time to time.

The version applicable to an order will ordinarily be the version in force when the relevant contract was formed unless a later change is required by law or lawfully agreed with the customer.

Governing Law and Jurisdiction

If you are a UK consumer, these Terms are governed by the mandatory laws applicable to your consumer relationship.

Nothing in these Terms prevents a consumer from relying on mandatory rights available under the law of the part of the United Kingdom in which they reside.

Disputes may be brought before a court having jurisdiction under applicable UK law.
